CRSP is a technology and notification service that publishes randomized daily colour information according to calendars established for participating physicians. It allows enrolled users to compare the daily colour information with the colour assigned to them by their physician or other authorized monitoring professional. 

The testing requirements established by a user’s physician may include, but are not limited to, urine, blood, hair, breath, or other forms of biological screening. CRSP does not determine which type of testing is required and does not collect, process, analyze, or receive biological specimens or test results.

EPIC’s role is limited to:

• maintaining and administering the CRSP technology;

• generating or administering the randomized colour calendars used by the service;

• displaying and communicating the applicable daily colour information;

• processing enrolments and annual service payments;

• providing reasonable technical support for the CRSP platform; and

• providing participating physicians with the applicable monthly colour calendar.

CRSP is not a medical, diagnostic, laboratory, specimen-collection, treatment, case-management, regulatory-compliance, or emergency service. Enrolment in CRSP does not create a clinician-patient relationship between you and EPIC.

Your physician or other authorized monitoring professional is solely responsible for:

• deciding whether randomized screening is appropriate for you;

• assigning and communicating your colour;

• determining the type, frequency, timing, location, and other requirements of testing;

• interpreting test results;

• determining the consequences of a completed, missed, delayed, unavailable, or disputed test;

• modifying or ending your monitoring requirements; and

• communicating with a regulatory college, employer, insurer, laboratory, or other third party, where applicable.

EPIC cannot assign, confirm, interpret, change, suspend, or waive your colour or testing requirements. Questions about these matters must be directed to your physician.

You are responsible for:

• obtaining and remembering the colour assigned to you by your physician;

• using a compatible smartphone and maintaining reliable device and internet access;

• providing a current and accurate email address;

• adding the CRSP email address to your approved or safe senders list and regularly checking your spam, junk, and other filtered email folders for CRSP notifications;

• keeping your login credentials secure;

• enabling app notifications and permitting CRSP emails through your email provider’s settings;

• checking the EPIC Nexus app every applicable testing day, even if you do not receive an email or push notification;

• comparing the daily colour information with the colour assigned to you;

• following all instructions provided by your physician;

• confirming laboratory locations, hours, closures, appointment requirements, and availability in advance;

• promptly contacting your physician if testing is unavailable or if you are uncertain about what is required; and

• contacting EPIC promptly if you experience a CRSP technical issue.

Email and push notifications are supplementary conveniences. They are not guaranteed delivery methods and do not replace your obligation to check the app. Notifications may be delayed or prevented by device settings, internet or cellular service, email filtering, full inboxes, operating-system settings, third-party service interruptions, or other circumstances outside EPIC’s reasonable control.

You are responsible for maintaining email settings that permit CRSP messages to reach your inbox and for checking spam, junk, and other filtered folders. Failure to receive or locate an email does not replace your responsibility to check the EPIC Nexus app on every applicable testing day.

CRSP colour schedules are designed around applicable testing days and anticipated laboratory availability. CRSP does not issue testing notifications on weekends or applicable statutory holidays. Individual laboratory hours, closures, appointment requirements, service interruptions, and specimen-collection availability may vary.

EPIC does not operate or control laboratories and cannot guarantee that a particular laboratory will be open or able to complete testing. If your usual location is unavailable, you are responsible for determining whether another appropriate location is available and for contacting your physician for instructions. EPIC cannot interpret or modify your testing obligation.

You must use the Authentication ID supplied or authorized for your enrolment. An Authentication ID is used to support program administration and relationships with participating physicians. It is not a medical record number and does not tell EPIC Recovery your assigned colour.

You must not share, publish, sell, transfer, or misuse an Authentication ID. EPIC may suspend or cancel access where an Authentication ID is used without authorization, where enrolment information is materially inaccurate, or where misuse threatens the security or integrity of CRSP. Any refund in those circumstances is subject to applicable law.
Authentication ID may be interchanged with Access Code language.

The CRSP fee is $114.95 plus applicable taxes for one year of access beginning on the activation date shown in your enrolment confirmation.

CRSP does not renew automatically. If continued access is required after the annual term, you must complete a new annual renewal and payment before the expiry date.

You may stop using or withdraw from CRSP at any time. However, withdrawing, no longer requiring monitoring, changing physicians, having your monitoring period shortened, failing to use the service, or using the service for only part of the annual term does not create an entitlement to a full or partial refund.

All fees are non-refundable except where a refund is required by applicable law or expressly approved by EPIC because EPIC is unable to provide the purchased service.

Withdrawal from CRSP does not change or end any testing, employment, licensing, regulatory, return-to-work, or monitoring requirement. You must speak with your physician before relying on any alternative arrangement.

Changes to Fees

EPIC reserves the right to change the CRSP annual fee. A fee increase will not affect an annual enrolment that has already been purchased and activated. Any revised fee will apply only to new enrolments and renewals completed on or after the effective date of the change. EPIC will provide registered users with at least 30 days’ notice of a fee increase by email, through the EPIC Nexus app, or by another reasonable electronic method. The applicable fee will also be disclosed before payment is completed. Continuing to use CRSP until the end of a current paid term does not require acceptance of the revised fee. A user accepts the revised fee only by choosing to purchase or renew CRSP at that price.

Technical support is available through CRSP@epicrecovery.ca during EPIC Recovery’s regular business operations. EPIC does not guarantee immediate or after-hours responses.

Technical support is limited to CRSP enrolment, account access, app operation, CRSP email delivery, and platform-related issues. EPIC technical support cannot advise you about your colour assignment, testing obligation, laboratory selection, missed testing, test results, clinical care, licensing requirements, or monitoring consequences.

EPIC uses reasonable administrative, technical, and operational measures to maintain CRSP. However, uninterrupted, error-free, or continuously available service cannot be guaranteed.

If EPIC identifies a material system outage affecting access to the daily colour information, EPIC will use reasonable efforts to:

• investigate and restore the affected service;

• provide available service-status information; and

• send the applicable daily colour information by email to registered users as soon as reasonably practicable, where that information can be communicated reliably and securely.

You remain responsible for checking available CRSP channels and contacting your physician if an outage, delayed notification, device problem, or other uncertainty may affect your testing obligation. EPIC cannot excuse a missed test or determine what alternative action is acceptable.

CRSP collects only the information reasonably required to administer the service. Within the CRSP application, EPIC collects and maintains:

• your name;

• your email address;

• the Authentication ID used for enrolment;

• your payment and enrolment dates; and

• related account, security, and technical records reasonably required to operate and protect the service.

EPIC does not collect or store your assigned colour within your CRSP account. EPIC does not collect, receive, interpret, or store your biological specimens, laboratory results, clinical records, diagnosis, treatment information, or information about whether you completed a required test through CRSP.

Your Authentication ID may allow EPIC to administer its relationship with a participating physician outside the user-facing app. EPIC may contact the applicable physician if a CRSP malfunction attributable to EPIC may affect the operation of that physician’s colour calendar or the delivery of daily colour information.

EPIC may use service providers for hosting, email delivery, payment processing, security, and technical operations. Those providers may process information only as required to perform their services and subject to applicable contractual and legal safeguards. Payment-card details are processed by the applicable payment provider and are not intended to be stored directly by EPIC unless expressly stated during payment.

EPIC handles personal information in accordance with its applicable privacy policies and Canadian privacy law. Questions or privacy requests should be directed through the contact method identified in EPIC Recovery’s Privacy Policy.

CRSP communicates randomized daily colour information. EPIC does not monitor whether you opened a notification, checked the app, attended a laboratory, completed a test, complied with an agreement, or maintained eligibility for employment or professional licensure, except for limited technical or security records that may be generated through ordinary operation of the platform.

Use of CRSP does not guarantee compliance with any physician direction, regulatory requirement, employment condition, monitoring agreement, insurance requirement, or return-to-work arrangement. You are responsible for confirming that CRSP is acceptable for your circumstances.

You must use CRSP only for its intended lawful purpose. You must not:

• interfere with, probe, copy, reverse engineer, disrupt, or attempt unauthorized access to CRSP;

• provide false or misleading enrolment information;

• use another person’s account or allow another person to use yours;

• manipulate or misrepresent daily colour information; or

• use CRSP in a manner that compromises another person’s privacy or the service’s security.

You must notify EPIC promptly if you believe your account or credentials have been compromised.

CRSP may depend on third-party services, including internet, cellular, device-operating-system, email, hosting, notification, and payment services. EPIC is not responsible for the independent acts, omissions, availability, policies, or performance of those third parties, but this provision does not limit any responsibility EPIC has under applicable law for its selection or management of service providers.

To the fullest extent permitted by law, EPIC is not responsible for:

• the acts, omissions, decisions, instructions, or availability of a physician, laboratory, employer, regulatory body, insurer, or other third party;

• specimen collection, laboratory procedures, testing accuracy, test results, or interpretation;

• your assigned colour or monitoring requirements;

• laboratory closures, reduced hours, appointment availability, travel, scheduling conflicts, or costs of testing;

• consequences arising from your failure to check CRSP, maintain accurate contact information, enable device settings, secure your account, or follow physician instructions; or

• delayed or failed notifications caused by circumstances outside EPIC’s reasonable control.

To the fullest extent permitted by law, EPIC’s liability arising from CRSP will be limited to direct, proven losses and will not include indirect, incidental, special, punitive, or consequential losses, including loss of employment, professional status, income, opportunity, reputation, or business.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from EPIC’s gross negligence, wilful misconduct, breach of applicable privacy obligations, or rights and remedies that cannot be waived under consumer-protection law.

EPIC may temporarily suspend CRSP where reasonably necessary for maintenance, security, legal compliance, misuse prevention, or service integrity. EPIC will use reasonable efforts to provide notice of planned material interruptions where practicable.

EPIC may update these Terms to reflect legal, security, technical, or operational changes. Material changes will be communicated through the app, by email, or through another reasonable method before they take effect, where required.

If EPIC permanently discontinues CRSP during a paid annual term, EPIC will provide an appropriate remedy, which may include continued access during a transition period, an alternative service arrangement, or a prorated refund, subject to applicable law and the circumstances of discontinuation.

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada. Any mandatory consumer rights available in the jurisdiction where you reside continue to apply.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. EPIC’s failure to enforce a provision on one occasion does not waive its right to enforce it later. These Terms, together with the policies incorporated by reference during enrolment, form the agreement governing CRSP.
